1. Agreement to Terms

By downloading, installing, or using the Rep mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Submit false, misleading, or fraudulent workout data
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems or bots to access the App
• Circumvent any security features or restrictions
• Collect or harvest user information without consent
• Post inappropriate, offensive, or illegal content

5. User Content

You retain ownership of any content you submit to the App ("User Content"), including profile information, workout data, photos, and comments. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App.

You represent and warrant that your User Content:

• Does not infringe any third-party intellectual property rights
• Does not violate any laws or regulations
• Does not contain false or misleading information
• Does not include harmful, offensive, or inappropriate material

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate at our sole discretion.

6. Challenges and Leaderboards

The App allows users to participate in workout challenges and appear on leaderboards. You acknowledge that:

• All workout data should be accurate and honestly reported
• Cheating, manipulating scores, or falsifying data is prohibited
• We may remove leaderboard entries that appear fraudulent
• Leaderboard rankings are provided for entertainment and motivation
• We are not responsible for disputes between users regarding rankings

7. Health Disclaimer

IMPORTANT: The App is intended for fitness tracking and motivation purposes only. It is NOT:

• Medical advice or a substitute for professional medical consultation
• A replacement for professional fitness instruction
• Intended to diagnose, treat, cure, or prevent any condition

Before starting any exercise program, consult with a qualified healthcare provider. You exercise at your own risk. We are not responsible for any injuries, health issues, or damages resulting from your use of the App or participation in challenges.

Listen to your body, know your limits, and stop exercising if you experience pain, dizziness, or discomfort.

8. Intellectual Property

The App, including its design, features, content, logos, and trademarks, is owned by Rep and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or decompile the App
• Use our trademarks without prior written permission
• Create derivative works based on the App

9. Third-Party Services

The App may integrate with or contain links to third-party services. We are not responsible for the content, privacy practices, or availability of these services. Your use of third-party services is subject to their respective terms and policies.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The App will meet your specific requirements
• Results obtained from the App will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKOUT CHALLENGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Rep and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

13. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause or notice. You may also delete your account at any time through the App settings or by contacting us.

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination (such as limitations of liability) will continue to apply.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rep operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rep regarding your use of the App and supersede any prior agreements.
